Liability

The MyPolice Belgium application is a mobile application that aims to provide its users with various information. This information is provided jointly by the Federal Police and the Local Police.

The Federal Police, represented by the Directorate of Police Information and ICT Resources (DRI), is the generic manager, but certain pages constituting a specific process are managed autonomously by various directorates of the Federal Police and/or police zones.

The Federal Police and the Local Police are the Data Controllers for the various contents of this mobile application. The Directorate of Police Information and ICT Resources is the Data Controller's representative for the development and maintenance aspects of the application. The Federal Public Services Chancellery of the Prime Minister and Policy and Support are its processor.

The Federal and Local Police make every effort to ensure that the general information provided is complete, correct, exhaustive, accessible and up-to-date. The Federal Police makes every effort to secure the mobile application by all reasonable means and limit any disruptions caused by technical problems as far as possible. However, the Federal Police and the Local Police cannot rule out the possibility that incorrect information may appear on the mobile application or that technical problems may occur, such as an interruption in the availability of the mobile application. If the information provided contains errors or if technical problems occur, the services concerned will make every effort to rectify the situation as soon as possible. The Federal Police and the Local Police cannot be held liable for any direct or indirect damage caused as a result of using this mobile application or the information provided. Neither can the Federal Police and the Local Police be held liable for any direct or indirect damage resulting from the use of hyperlinks to other websites referred to on this mobile application.

Purpose and content of this mobile application

This mobile application provides you with general information and also gives you the option of easily and securely communicating to us the data which we use to provide an appropriate service.

Where possible, and with your consent, we will pre-populate certain data for you.

Nature of the information provided

The information available on this mobile application is of a general nature for non-emergency situations. This information is not intended to cover personal or specific situations and therefore cannot be considered as personal, professional or legal advice. This mobile application and its content are provided in their current state, without any guarantee. This mobile application and the information contained therein are used exclusively at your own risk.

If you need specific or personalised advice, you should always consult the relevant persons within the Federal Police.

The information and documents provided on this mobile application cannot be considered as an authentic reproduction of the officially adopted texts. Only official texts published in the Belgian Official Gazette are considered authentic.

With your consent, the forms you are asked to complete to provide us with your data can be pre-populated. This data will be extracted securely from authentic data sources and in accordance with the privacy legislation.

Intellectual Property

Unless expressly stated, the texts, photos, illustrations, video and audio files available on this mobile application may only be used with the express, written and prior authorisation of the Federal Police and the Local Police.

File uploads

The Federal Police cannot guarantee unlimited uploads. The Federal Police therefore reserves the right to decide on the uploaded information that will ultimately be placed on the mobile application. The Federal Police can decide to remove certain information from this mobile application at any time. The Federal Police can regularly monitor the content

of the uploaded information. The Federal Police cannot rule out the possibility that access to the upload service may be interrupted or disrupted in any way as a result of technical alterations or unauthorised interventions. The Federal Police expressly reserves the right to interrupt access to the upload service, at any time and without prior notification in order to detect or prevent possible cases of abuse or fraud or to remedy technical or operational problems. The Federal Police can prevent you from accessing the upload service at any time and without prior warning if it observes that you are not complying with the terms of service governing the upload service. By uploading information, you authorise the Federal Police to use the material concerned on the website or the mobile application. You guarantee that the information you upload does not infringe the intellectual property rights or other third party rights and you shall fully indemnify and hold harmless the Federal Police from and against any claims, losses, attorneys' fees, damages, costs and any other actions for damages arising out of such an infringement. Under no circumstances are you permitted to upload information of a racist, hateful, offensive or pornographic nature, or that contravenes moral standards and/or Belgian legislation, or that is contaminated by a virus or similar malware, or that can harm the Federal Police or third parties in any other way. It is also forbidden to upload commercial advertising or any other promotional material. You will fully indemnify the Federal Police for any direct or indirect damage caused to third parties as a result of uploading such unauthorised information. You are not permitted to use the upload service in any way that could disrupt, overload, or impair the service or negatively impact the user experience. The Federal Police asks you to report any inappropriate information that has been uploaded, so that it can take the necessary and appropriate steps to alter or remove such information or make it inaccessible.

Modifications

The Federal Police reserves the right to modify these Terms of service. It is your responsibility to review the applicable terms on a regular basis.

Personal data protection

The Federal Police respects your privacy. The data you enter on the mobile application will be treated in complete confidentiality. For more information, please read our privacy statement of the MyPolice Belgium application.

Log files

The Federal Police records your visit to this mobile application. This information is used exclusively for the purposes of computer system security or to improve the mobile application. Technical log files intended solely for technical support are kept for a maximum of one month.

Applicable law and jurisdiction

By using this mobile application, you agree that the courts of Brussels have sole jurisdiction in the event of a dispute and that only Belgian law is applicable.
